Terms of Service

1. Acceptance of terms

By creating an account or using Painly (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service. These Terms form a legally binding agreement between you and Painly, operated from France.

2. Service description

Painly is a lead-generation tool that scans publicly available Reddit posts, scores them for purchase intent using AI, and surfaces relevant leads to subscribers. The Service includes keyword search, intent scoring, AI-drafted reply suggestions, email alert digests, and a trending pains feed. Painly is not affiliated with Reddit, Inc.

3. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Service. By using Painly, you represent that you meet these requirements.

4. Acceptable use

You agree to use the Service only for lawful purposes. You must not:

  • ·Use Painly to spam Reddit users, send unsolicited bulk messages, or engage in any form of harassment.
  • ·Use the Service in a way that violates Reddit's User Agreement or Content Policy.
  • ·Attempt to circumvent or abuse search quotas (e.g. by creating multiple free accounts).
  • ·Use automated scripts or bots to access the Service outside of official API integrations.
  • ·Resell, sublicense, or redistribute search results or lead data to third parties without written permission.
  • ·Use the Service to collect personal data about Reddit users for purposes other than direct business outreach.
  • ·Attempt to reverse-engineer, decompile, or copy any part of the Service.

We reserve the right to suspend or terminate accounts that violate these rules without prior notice.

5. Subscriptions and billing

Plans

Painly offers Free, Pro ($19/month), and Agency ($49/month) plans. Plan features and limits are described at painly.app/#pricing and may change with reasonable notice.

Payment

Paid plans are billed monthly in advance. All payments are processed securely by Stripe. By subscribing, you authorise us to charge your payment method on a recurring monthly basis.

Cancellation

You may cancel your subscription at any time via Settings → Billing → Cancel subscription. Cancellation takes effect at the end of the current billing period. You retain full access to paid features until that date. We do not offer refunds for unused portions of a billing period.

Price changes

We will give at least 30 days' notice of price changes by email. Continued use after the notice period constitutes acceptance of the new price.

6. Intellectual property

The Painly name, logo, and application code are our exclusive property. Reddit post content surfaced by the Service remains the property of its respective authors and is subject to Reddit's terms. AI-generated summaries and reply drafts are provided as suggestions only — you are responsible for how you use them.

7. Disclaimer of warranties

The Service is provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that search results will be accurate, complete, or current. Reddit data is fetched from a third-party source and we cannot guarantee its availability. AI scoring is probabilistic and should not be relied upon as the sole basis for business decisions.

8. Limitation of liability

To the fullest extent permitted by applicable law, Painly shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, lost data, or business interruption — arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 3 months immediately preceding the claim.

9. Indemnification

You agree to indemnify and hold Painly harmless from any claims, damages, or expenses (including legal fees) arising from your violation of these Terms, your use of the Service, or your violation of any third party's rights.

10. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms, non-payment, or any other reason at our discretion. You may delete your account at any time via Settings. Upon termination, your right to use the Service ceases immediately.

11. Changes to these Terms

We may update these Terms from time to time. We will notify you of material changes by email at least 14 days before they take effect. Continued use of the Service after that date constitutes acceptance.

12. Governing law and disputes

These Terms are governed by the laws of France. Any dispute arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of France. If you are a consumer in the EU, you may also have recourse to the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
